General conditions of sale
These general conditions of sale regulate the commercial relations of sale of goods and services between Sail and its customers. Any other agreement, unless agreed in writing, is excluded. The placing of an online order on the site www.Top-Welding.com, implies full acceptance of the conditions expressed in this agreement.
The contract between Sail srl and the customer is concluded with the partial or full acceptance of the order by Sail srl. By placing an order, the Customer declares to have read and accepted all the information provided to him in the various stages of purchase, and to fully accept the general conditions and payment terms.
Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the total or partial non-acceptance of an order and for any improper use of the purchased products. All products sold by Sail srl are CE marked, therefore before using them it is the consumer's obligation to read all the safety measures indicated by the company.
Sail srl reserves the right to cancel an order, against refund of the amount paid by the purchaser, due to lack of availability of the material or for other reasons even after payment. Furthermore, any claim for compensation for the unavailability of the products is excluded. The purchaser will be entitled to a refund of the total amount paid or can claim a credit of the same amount for the choice of alternative products.
Sail srl shall not be liable for delays caused by the lack of availability by the supplier or for any delay not directly attributable to Sail srl. If, due to force majeure, it is not possible to complete the order even after the indicated time, Sail srl will, upon request of the customer, immediately refund the payment and cancel the order. In case of payment by bank transfer, the customer undertakes, upon request of Sail Srls, to provide the data necessary to make the bank transfer to cancel the payment.
Sail Srls is not liable for damages caused during transport by the carrier, who is the only responsible for the transported goods. Any request for replacement, return or cancellation for this kind of damage can be made only if at the time of delivery any damage to the packaging has been notified to the carrier by "signing with reserve". The possible replacement of the product will be carried out only after all the checks carried out upon the return of the defective product, within and no later than 14 working days (subject to availability of the replacement).
Sail srl is not responsible for the delayed and/or non-delivery of the product. For customers living abroad or for transactions in countries other than Italy Sail srl is not responsible for any charges or laws that may preclude the sale or burden the product with additional costs.
The technical information included in the website: www.Top-Welding.com, are those compiled by the manufacturers. Sail reserves the right to modify the technical information of the products at any time without giving previous notification or other communication. The information contained in the catalogue/website, in particular texts, photos, graphics, illustrations, and all trademarks, patents, utility models and copyrights, are the property of their respective manufacturers. Different uses, other than consultation and purchase of the materials contained in the site, are not permitted without the written consent of us or the owner of the rights and/or copyright. Sail produces with care and diligence the technical information and product descriptions, nevertheless, in case of inaccuracies or errors Sail is not in any way responsible and does not provide any warranty for any shortcomings, errors or inaccuracies contained in the site. The images are for indicative purposes only, please refer to the manufacturer's data sheet for details and features.
Orders are accepted only and exclusively by Email or Web (online), or by telephone. The orders placed on the website generate an automatic email confirming the reception of the order. The email sent automatically does not represent in itself a confirmation of acceptance of the order. The orders are considered accepted at the shipment of the goods.
All prices listed on the website, are in Euro including VAT applicable on the day of order. Prices and discounts may be changed at any time, without notification. The prices of some types of products may be subject to sudden changes even substantial. In case of disputes, Sail reserves the right to accept and ship the order. However, the price published on the site at the time of order is valid. The prices indicated include the costs of handling the order, transport, and shipping according to the areas indicated.
6- Products Availability
Items not available are highlighted when ordering on Top-Welding.com. However, the final availability of each item is confirmed during the process of order. In case the customer sends a payment but for any reason the goods are not delivered, Sail will immediately return the due.
7-Shipments and verification on delivery
STANDARD SHIPPING: Delivery times for Standard Shipment may vary depending on the item. They are shown on the product page and in the order confirmation email. The days expressed in the delivery times are working days. If the delivery time is longer than 14 days, an estimated delivery date expressed in weeks is indicated.
Standard shipping in Italy is free for all orders worth more than €70 VAT Included, (Calabria, Sicily and Sardinia more than €100); the amount of shipping costs will be highlighted when checking out the online order. In case your order contains two or more products with different delivery times, the shipment will be divided WITHOUT ADDITIONAL COSTS. Upon delivery of the goods, the customer must verify the integrity of packages and correspondence with what is indicated in the accompanying document. If non-conformities are detected, they must be reported using the form on the back of the accompanying document and sent within fourteen days by email to Sail Srls at info@Top-Welding.com.
8- Ownership reserve
The ownership of the goods passes to the customer when it is entrusted to the courier for shipment. The merchandise moves at the customer's own risk even when it is turned in customer's premises. Sail retains ownership of all delivered goods until final and total payment of the delivered goods.
Sail guarantees that upon delivery of the goods, it will be free from defects or damage of any kind. The purchase of material from Sail, involves the acceptance of the warranty conditions. The purchased goods are guaranteed under the conditions provided by the manufacturer. The customer therefore accepts without reservation, all the modalities of performance of the manufacturer's warranty. The warranty period is 12 months for professional use and 24 months for domestic use from the reception of goods. Prerequisite to exercise the right to warranty is that the defect was not caused by improper use. The right to the warranty can be fulfilled by Sail through the replacement of the defective product, or through the replacement with a similar product only if it has equal or superior characteristics, or in the end through reparation. If this is not possible, Sail may terminate the purchase contract and return the money spent to the customer in full refund.
The warranty does not extend to accessories and components subject to normal use, such as ground pliers, belts, electrode holders, handles, cables, electrodes and other accessories in general...supplied with the welding machines or separately.
Before sending us the welding machine to be fixed, it is necessary to request our authorization. Frequently, telephone assistance can solve welding machine operation problems related to technical settings and adjustments. In some cases, moreover, for some brands there is a network of competent and equipped service centres throughout Italy.
Warranty period: Outward transport charged to the customer; repair and outward transport at our charge.
Period out of warranty: Transport in and out are at the customer's charge + the cost of the fix.
Any shipping errors or lack of material must be reported in writing. Even in the presence of intact packaging, the goods must be verified within eight calendar days from the reception. Eventual anomalies deriving from transport damages will have to be reported by written form, by registered letter A.R. to the courier and in copy to Sail detailing the damage found and putting "detailed reservation" on the transport document of the courier. Any report beyond these terms, won't be considered. Any hidden defects or anomalies must be reported in writing using the form on the back of the transport document by registered letter:

The goods supplied will have to be paid with:
-Bank transfer in advance
-Cash on delivery
-Payment in instalments via Soisy
Any other form of payment must be stipulated in a written agreement with Sail. Sail anyway reserves the right not to proceed with the shipment of the goods, even after receiving the order, for those customers who are "out of credit" or with "outstanding balance" or " open litigation". Sail reserves the right, where it deems appropriate, to ship the goods only upon payment in advance.
12 - Obligations related to the tracking of financial flows - Law 136/2010
The client - if the order concerns the execution of an order subject to the scope of Law no. 136/2010, must comply with all the provisions of that law. The customer must pay for the goods exclusively by bank transfer and/or with suitable instruments to ensure full trackability of the transaction.
13-Cancellation of orders, right of withdrawal
It will be possible to exercise the right of withdrawal within and no later than 14 days from the date of receipt of the goods according to Legislative Decree 206/2005. Sail reserves the right to accept such return in particular in case the goods have been expressly ordered to its supplier and for material orders. The cancellation of the order or part of it must be requested in a written form (fax, letter), to:

The cost of shipping the returned goods will be charged to the customer. The deadline within the refund will be made will be 14 calendar days from the reception of the goods at Sail; the refund will also include any transport costs incurred at the time of the order.
The return of goods must be requested in a written form on the back of the transport document. The reasons for the return and the purchase reference of the goods must be indicated. The goods to be returned must be in perfect condition, complete with all accessories, in the original packaging, and sent carriage paid to the address:

15-Confidentiality and personal data
The customer is aware that "personal data" communicated or registered on the Top-Welding.com website, will be subject to the processing of personal data in accordance with the requirements of art.13 of EU Regulation no.679/2016
For any dispute that may arise, the Court of Vicenza shall have jurisdiction.
For any communication with Sail regarding payments, complaints or other, regarding placed orders, you must always indicate the reference number and customer number that appear on the invoice and delivery note.
18- Application of these conditions
The conditions contained in this document may be changed without notification. Date of publication on Top-Welding.com website will be considered as the date of reference.
